The City Council launches an ordinance regulating street trading and markets in Puerto Lumbreras (30/09/2015)

The Municipal Council has approved the implementation of an ordinance peddling and markets to improve the regulation of this trade in the city.

The Ordinance consists of 30 articles, including the requirements for the exercise of trade away from business premises, the procedure for awarding vacancies for traders and penalties for committing offenses.

Wednesday, September 30, 2015. The City Council of Puerto Lumbreras, through the City Council, has approved the implementation of an ordinance peddling and markets to improve the regulation of this trade in the city.

Specifically, the ordinance is to establish the legal framework for the management and monitoring of the sale that takes place in the municipality of Puerto Lumbreras by merchants outside permanent commercial establishment of regular, casual, periodically or continuously, in places duly authorized removable or transportable and commercial facilities.

Markets Councilman Juan Francisco Carrillo, explained that "this measure aim to improve market regulation and peddling and to provide citizens access to permit sale".

In this sense, the Ordinance, composed of 30 articles, including the requirements for the exercise of trade away from business premises, the procedure for granting vacant places for merchants, the penalties for committing offenses.

Furthermore, the ordinance the location, time and number of seats for the markets and street vending indicated.

Thus, among the requirements to have professional stands peddling license or equivalent documentation, be registered under the heading of business tax, be registered in the Social Security System and have insurance against civil liability that cover risks in business.

In terms of activity, it is required to have exposed to public sales prices of goods and make available to consumers complaints sheets.

In addition, the ordinance states that the use of public address equipment and authorization holders shall be liable restricted to leave the place clean sale of all waste, packaging and any type of waste generated, which must be deposited in containers ready for this purpose.

Regarding authorizations, the ordinance states that the authorizations outside permanent commercial establishments are granted by the Local Government Board, or by delegation on behalf of the competent council.

Also, sales authorizations are personal and not transferable.

Finally, it notes that this ordinance is adapted to the Law on Street Vending Sedentary or not the Region of Murcia.
